There are thousands of criminal cases going through the Duval County State Attorneys Office at a time. These cases are delegated to assistant state attorneys. The delegation depends on the type of crime and the division in which it is assigned. Corey does not usually prosecute the cases herself, but she elected to prosecute Dunn’s first degree murder case (Duval County State Attorney to Prosecute Jacksonville Stand Your Ground Case). Corey was not the prosecutor during the Zimmerman trial. However, she did make the decision to file the second degree murder charge against him. It was her office and attorneys that made decisions in prosecution of the case.
The Dunn case is another murder case that involves Florida self defense laws. This is a case in which Jacksonville lawyers have discussed the Florida stand your ground law. It has not been a high profile case like Trayvon Martin’s murder case. That could change due to Zimmerman‘s not guilty verdict and the media’s attention on Florida lately.
“The Florida Civil Rights Association is calling on Gov. Rick Scott to remove State Attorney Angela Corey from prosecuting the man charged with killing 17-year old Jordan Davis…. Police said Dunn, 46, who is white, shot into a Dodge Durango with four black teens in a dispute about loud music. Only Davis was hit. Dunn is charged with first-degree murder and three counts of attempted murder. Corey is personally prosecuting the case. Association president J. Willie David III said Corey’s unsuccessful prosecution of George Zimmerman has created racial tension. Zimmerman, who is Hispanic, shot and killed Trayvon Martin and was acquitted this month on the basis of self-defense. Corey was the special prosecutor in that case.” (Jacksonville.com)
Jordan Davis’ family does not agree with the Association. “[T]he Davis family said they were not consulted about this and don’t want Corey off the case. Attorney John Phillips, who represents the Davis family, said his clients were not consulted before David sent out his letter. ‘The Florida Civil Rights Association never called us, sought our input and yet went to the media with their opinion of what is ‘best for Jordan,’ Phillips said. The family does not support what the civil rights organization is asking for and prefers this case be prosecuted by a Jacksonville prosecutor, Phillips said.
Dunn’s jury selection date is September 23, 2013. Although the trial has been set, it could be continued, because “but attorneys for Dunn have said they will not be ready by that date.”
